COUNCIL DECISION (CFSP) 2024/1738

of 24 June 2024

amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

On 17 March 2014, the Council adopted Decision 2014/145/CFSP (1).

(2)

In its conclusions of 21 and 22 March 2024, the European Council reaffirmed the Union’s steadfast support for Ukraine’s independence, sovereignty and territorial integrity within its internationally recognised borders and recognised Ukraine’s inherent right of self-defence against the Russian aggression. The European Council also called for further steps to weaken Russia’s ability to continue waging its war of aggression, including by strengthening the sanctions.

In view of the gravity of the situation, it is appropriate to adopt further restrictive measures.

(4)

In particular, the Council considers that 69 persons and 47 entities responsible for actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine should be added to the list of persons, entities and bodies subject to restrictive measures set out in the Annex to Decision 2014/145/CFSP.

It is appropriate to introduce a derogation allowing the release of funds that were frozen due to the involvement of a listed intermediary bank in their transfer, under the conditions that the transfer is between two non-listed natural or legal persons, entities or bodies and is carried out using accounts at non-listed credit institutions. Additionally, it is appropriate to introduce a derogation allowing the release of funds that were frozen due to the involvement of a listed issuing bank in their transfer, under the condition that the transfer is between two non-listed natural or legal persons, entities or bodies.

In line with the Union’s common foreign and security policy objectives of preserving peace, reinforcing international security and promoting international cooperation, democracy and the rule of law, and more specifically the objectives pursued by Decision 2014/145/CFSP, it is appropriate to ensure that the documents held by the Council, the European Commission and the High Representative of the Union for Foreign Affairs and Security Policy (the ‘High Representative’) concerning the enforcement of the restrictive measures set out in that Decision or in Council Regulation (EU) No 269/2014 (2), or concerning the prevention of the violation or circumvention of those measures, are subject to professional secrecy and enjoy the protection afforded by the rules applicable to the Union institutions, since information contained in those documents could be used to obstruct the enforcement of those measures or to compromise their effectiveness, given that the persons and entities concerned could act in such a way as to prevent their enforcement. That protection should also be ensured for proposals from the High Representative for the amendment of Decision 2014/145/CFSP and any related preparatory documents, as their disclosure might affect the effectiveness of the measures set out in that Decision or in Regulation (EU) No 269/2014 and the preparation of, and negotiation on the basis of, future proposals. Certain measures which are included in such proposals, and which cannot be adopted by the Council for various reasons, are often included by the High Representative and the Commission in subsequent proposals. It is important to protect that power of initiative from any influence exerted by public or private interests that attempt, outside of organised consultations, to compel the Union institutions and Union services to propose, adopt, amend or agree on an amendment. Their disclosure could render the possible new asset freeze measures ineffective due to the fact that their intended adoption would have already been revealed. Thus, it should be presumed that disclosure of those documents would harm the security of the Union or that of one or more of its Member States or the conduct of their international relations.

Decision 2014/145/CFSP should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Decision 2014/145/CFSP is amended as follows:

(1)

in Article 2, the following paragraphs are added:

‘31.   By way of derogation from paragraphs 1 and 2 of this Article, and provided that the funds concerned were frozen as a result of the involvement of a legal person, entity or body listed in the Annex to this Decision acting as intermediary bank during a transfer of those funds from the Russian Federation to the Union, the competent authorities of a Member State may, under such conditions as they deem appropriate, authorise the release of certain frozen funds, after having determined that the transfer of such funds is:

(a)

between two natural or legal persons, entities or bodies that are not listed in the Annex to this Decision;

(b)

carried out using accounts at credit institutions that are not listed in the Annex to this Decision; and

(c)

not in breach of paragraph 2 of this Article.

This paragraph shall not apply in relation to frozen funds or economic resources held by Central securities depositories within the meaning of Regulation (EU) No 909/2014.

32.   By way of derogation from paragraphs 1 and 2 of this Article, and provided that the payment concerned was frozen as a result of a transfer from the Russian Federation to the Union initiated through or from a legal person, entity or body listed in the Annex to this Decision, the competent authorities of a Member State may, under such conditions as they deem appropriate, authorise the release of that frozen payment, after having determined that the transfer of that payment is:

(a)

between two natural or legal persons, entities or bodies that are not listed in the Annex to this Decision;

(b)

not in breach of paragraph 2 of this Article.

This paragraph shall not apply in relation to frozen funds or economic resources held by Central securities depositories within the meaning of Regulation (EU) No 909/2014.

The beneficiaries of a transfer as referred to in the first subparagraph of this paragraph shall only be nationals of a Member State, of a country member of the European Economic Area or of Switzerland, or natural persons having a temporary or permanent residence permit in a Member State, in a country member of the European Economic Area or in Switzerland.

One authorisation per applicant may be granted under this paragraph.

The Member State concerned shall inform the other Member States and the Commission of any authorisation granted under this paragraph within one week of the authorisation.’

the following article is inserted:

‘Article 4a

1.   Any document held by the Council, the Commission or the High Representative of the Union for Foreign Affairs and Security Policy (the “High Representative”) for the purpose of ensuring the enforcement of the measures set out in this Decision, or of preventing the violation or circumvention thereof, shall be subject to professional secrecy and shall enjoy the protection afforded by the rules applicable to the Union institutions. That protection shall apply to the proposals from the High Representative for the amendment of this Decision and to any preparatory documents related to them.

2.   It shall be presumed that the disclosure of any documents or proposals referred to in paragraph 1 would harm the security of the Union or that of one or more of its Member States or the conduct of their international relations.’

the Annex is amended in accordance with the Annex to this Decision.

Article 2

This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.

He himself has spoken aggressively and in a biased manner against the democratically elected authorities of Ukraine and has always emphasised his full support for Russia’s aggressive policy towards Ukraine. He has been actively involved in multiple projects conducted in occupied Ukrainian territories for media specialists, such as the “Academy of Emotions” funded by the Presidential Fund for Cultural Initiatives and established to promote the war. His company Mash manages regional publications of the Mash propaganda project. He is also a sponsor of the WarGonzo Z-military project, whose correspondents have been conducting anti-Ukrainian propaganda since the beginning of the war. Therefore, Aram Gabrelyanov is supporting and implementing actions and policies which undermine and threaten the territorial integrity, sovereignty and independence of Ukraine.

Vadim Yakovenko is Head of the Federal Agency for State Property Management (Rosimushchestvo), a Russian federal executive body managing federal property, which organises the sale of federal property to be privatised and property seized in accordance with a court decision or directives of other agencies. Rosimuschestvo is responsible for taking control over multiple Western assets with Decree No. 302 “On Temporary Management of Certain Property” signed by the President of the Russian Federation Vladimir Putin. That decree was signed to ensure the stable functioning of the Russian energy sector and the uninterrupted operation of companies significant for the Russian economy. In addition, Rosimuschestvo contributes significantly to the revenue of the Russian Federation.

As Head of Rosimuschestvo, Vadim Yakovenko is supporting, materially and financially, and benefitting from the Government of the Russian Federation, which is responsible for the annexation of Crimea and the destabilisation of Ukraine.

Furthermore, Rosimuschestvo is actively involved in contributing aid to the activities of the Russian Federation in the occupied Ukrainian territories of Donbas. As Head of Rosimuschestvo, Vadim Yakovenko is supporting and implementing actions and policies which undermine and threaten the territorial integrity, sovereignty and independence of Ukraine.

JSC Hydromash fulfils Russian state defence orders, and its products (chassis and other hydraulic units) are used by the Armed Forces of the Russian Federation. In her re-education programmes, she cooperates with Ramsan Kadyrov and the “Movement of the First”, a state-led youth organisation in the Russian Federation, which was created in December 2022 at the initiative of President of the Russian Federation Vladimir Putin to provide educational activities, including of a militarised nature, for children between the ages of 6 to 18, based on “traditional Russian spiritual and moral goals”.

Furthermore, Olga Koludarova aims to synchronise the legislation of the so-called “Donetsk People’s Republic” and the Russian Federation in the educational sphere. Therefore, Olga Koludarova is supporting and implementing actions and policies that undermine the territorial integrity and sovereignty of Ukraine.

The Tallamkho Design Bureau (“Pathfinder”) was established in 2022 and is based in Grozny, Chechen Republic. The organisation specialises in dual-purpose IT developments and operates under the auspices of the team of Chechnya’s head Ramzan Kadyrov.

The Tallamkho Design Bureau has developed the system called BUKH1a “Sova” (“Owl”), which is a modification of the 1B75 Penicillin acoustic-infrared reconnaissance system. The company has confirmed that the system has been on combat duty in the special military operation zone.

Moreover, the Tallamkho Design Bureau has developed a new acoustic drone detector “Malik” for use in the special military operation zone. The device detects unmanned ariel vehicles by sound. The detector is available in two versions: a stationary version for installation in trenches, dugouts and vehicles, and a portable version which is hung on a bulletproof vest. The detector is also capable of detecting rangefinders, PTRK lasers and sniper sights.

It manufactures military sights, including PM-10 and PM-25 mortar sights, PGO-7V3 optical sight for grenade launcher, and PSO-1M2 Sniper optical sight. Those products are widely used and compatible with military weaponry used by Russia.

JSC BelOMO LEMT EMT is also part of the BelOMO holding. It specialises in the research and development, production and modernisation of optoelectronic and laser devices for unmanned aerial vehicles, laser-optical systems for air defence systems, and integrated border security and protection systems. BelOMO LEMT EMT also produces optical sights and systems for light armament, laser rangefinders, range-finding modules based on diode lasers, and laser fire control systems, including specifically for Russian weapons. BelOMO LEMT EMT also exports to Russia and is developing new laser weapons together with Russia.
